  • Andrew Miltenberg Dismissal in Freeze-out Merger Case
    Representing minority shareholders of an $80 million piece of Wall Street real estate, Nesenoff & Miltenberg, LLP brought suit against majority shareholders who tried to eliminate the minority’s ownership interest in the real estate in exchange for zero consideration. The majority shareholders raised a litany of procedural and technical objections and moved to dismiss the case in its entirety. The Supreme Court, New York County, sided with the NMLLP team and denied the motion, permitting the minority shareholders’ case to move forward.

  • Andrew Miltenberg Summary Judgment in Real Estate Fraud
    Nesenoff & Miltenberg, LLP successfully overcame a defendant law firm’s Motion for Summary Judgment, which argued that the Statute of Limitation had expired with respect to Plaintiff’s claims for malpractice.  The law firm, which allegedly assisted in a scheme to defraud its client out of his $1.4 million real estate investment, sought to dismiss the case, arguing that the firm’s actions fell outside of the three-year statute.  The New York Supreme Court, Justice DeStefano, held that the evidence – an engagement letter signed by the defendants in particular – demonstrated that NMLLP’s client’s claim was timely.

  • Andrew T. Miltenberg and Philip A. Byler Win Dismissal of Adverse Possession  Claim in Six-day Jury Trial
    After four years of litigation and a six-day jury trial in New York Supreme Court, including testimony from 12 witnesses and nearly 100 exhibits, Andrew T. Miltenberg and Philip A. Byler secured a unanimous jury verdict in favor of the defendant dismissing plaintiff’s claims for adverse possession and trespass.  The Jury then granted the NMLLP client’s counterclaim for trespass.

  • Philip A. Byler Wins Second Circuit Appeal in Fiercely Contested Bank Dispute
    Nesenoff & Miltenberg, LLP Senior Litigation Counsel Phil Byler persuaded the U.S. Court of Appeals for the Second Circuit to reverse a Southern District of New York decision compelling arbitration and dismissing the NMLLP client’s claims for securities fraud and breach of contract in the loss of customer monies by a national bank.  The trial court ruled that the bank could invoke a change-of-terms provision in its contract with a customer to issue a new contract that required arbitration.  The Second Circuit sided with Phil Byler and reversed the trial court, holding that the bank would not be allowed to enforce the change-of-terms provision.

  • Barbara Trapasso Named 2012 Recipient of 17th Assembly District "Women of Distinction" Award

  • Andrew T. Miltenberg Retained to Represent Custer Battlefield Museum in U.S. Federal Court of Claims Against United States
    Christopher Kortlander, founding director of the Custer Battlefield Museum, and the businesses he operates at Garryowen, Montana have filed a multimillion dollar lawsuit in the US Federal Court of Claims in Washington DC against the United States. The lawsuit was filed in response to the actions of various law enforcement agents of the Bureau of Land Management, the US Fish and Wildlife Service, the Department of the Interior, and the United States. Kortlander states that the purpose of the suit is to recover from the damages caused by years of malicious prosecution by the many federal agencies involved in two raids on his businesses and private residence.

  • Andrew T. Miltenberg win Preemptive Strike Against National News Program
    A successful cease and desist effort against a national news program.  The program had threatened to air a defamatory "investigative report" that would have painted Nesenoff & Miltenberg, LLP’s client – a US Green Building Council member company – in a negative and false light.  After conducting an investigation of its own, the Nesenoff & Miltenberg, LLP team prevented the airing of the story.

  • Megan S. Goddard Secures Pregnancy Discrimination Settlement
    On behalf of a victim of pregnancy discrimination, Megan Goddard secured a settlement award equal to three full years of salary.

Shari S. Laskowitz Secures Money Judgment against Commercial Tenant
Shari Laskowitz secured a six-figure money judgment plus legal fees against a client’s commercial tenant, the tenant’s guarantor of lease, and the tenant’s successor business entity, based upon alter-ego theory and lease violation.

Andrew T. Miltenberg Victors in Real Estate Partnership Dispute
After multiple hearings, motions, tens of thousands of documents and  over a dozen witnesses, Andrew Miltenberg emerged victorious from a closely-contested arbitration.  A three-arbitrator panel found in favor of Nesenoff & Miltenberg, LLP’s clients, dismissing multiple defenses and counterclaims of the heirs to a real-estate partnership and finding in favor of its current partners.
